Privacy Policy

Preamble: exists to facilitate a long term study on the use of technology to deliver real-time feedback to students during lessons. Details of the ethos and pedagogy this approach promotes can be found at the Learning By Questions website.

The current study is now closed to new participants but access to the resources and features may be available via our Beta Testing Programme.

Full access to all the features and content requires an account with Accounts are issued at the sole discretion of Learning Clip Ltd. Accounts may be revoked or restricted at any time at the sole discretion Learning Clip Ltd. For users without an account no personal information is captured.

We place a high priority on safeguarding the privacy of users of (hereafter referred to as 'the site'). Many of the features of the site require users to be logged in to their account (hereafter referred to as ‘your account’). This privacy policy is intended to help you understand what personal information we collect and how it is used when you are logged into your account.

Our aim is to collect the minimum personal information required to make your use of the site enjoyable and easy. By using or providing information requested by the site you agree to accept the terms of this Privacy Policy which shall take effect immediately on creation of your account. If you do not agree to be bound by all of the following terms please do not use your account. Learning Clip Ltd reserves the right to modify this Privacy Policy at any time without giving you prior notice. Your use of your account following any such modification constitutes your agreement to be bound by this Privacy Policy as modified.

  1. The information we collect.

    1.1 Required Information

    To create your account on the site, we collect your name and email address.

    As a registered user of the website, we will on occasion send you transactional emails. For instance to notify you of changes to the website or your account. These emails are required for logistical purposes and users cannot opt-out of these at any time.

    When you log in to the site and use the site we record the following information; date and time of log in, IP address of PC or network you are accessing the internet from, which resources you viewed, when you viewed them and in what way you used them. We use this information internally to: help identify potential problems, enhance the quality of our service, help diagnose problems experienced by users who contact us requesting technical support, monitor compliance with trial usage goals (applies specifically to users participating under trial conditions).

    If you contact Learning Clip Ltd we will normally keep a record of that communication.

    1.2 Optional Information

    School Record: some features of the site are only available to users who (in addition to a standard user account) are members of a school account. In such instances we will additionally record the name and address of their school.

    User authored content: The site allows users to author questions and upload image and sound files which may be shared with other users (including students). Learning Clip Ltd is not responsible for the quality or propriety of such content, additionally it is the responsibility of the user authoring such content to ensure they have not infringed the intellectual property rights of third parties. Learning Clip Ltd reserves the right to reuse, remove or limit access to any user authored content at our sole discretion.

  2. What are cookies and how does Learning Clip Ltd use them?

    Cookies are small files placed on your computer when you visit the site.

    Session Cookies: are required to maintain access to your account after you have logged in to the site. If these cookies are not permitted you will not be able to log in correctly or access many features of the site.

    Functional Cookies: are used to temporarily store information about your use of the site. For instance, cookies will remember the criteria you have used to search for an item of content so when you return to a page your search criteria will be recovered.

    Analytic Cookies: are third-party cookies and collect anonymous information about how visitors use our website. This data is used to improve and maintain the site.

  3. Who is collecting information?

    When you are on the site and are asked for personal information, you are sharing that information with Learning Clip Ltd. and associated companies within the Learning By Questions Ltd. Group, unless it is specifically stated otherwise in this policy or in an offer or survey form or registration form that you may be asked to complete as part of utilizing the service.

    Learning Clip Ltd. reserves the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on Learning Clip Ltd.

  4. Your right to access personal information held about you by Learning Clip Ltd

    At any time you may send us an email to to request a copy of the personal information held about you by Learning Clip Ltd. If requested, Learning Clip Ltd will provide an e-mail response within thirty (30) days. This will normally be subject to an administration fee of £35.

  5. What security precautions are in place to protect my information?

    Learning Clip is registered with the ICO and all data collected and stored by us is handled in compliance with the Data Protection Act 1998 (DPA). We apply a range of measures to protect personal information submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, should be regarded as 100% secure. Therefore, while we strive to use appropriate means to protect your personal information, we cannot guarantee its absolute security.

    Your account information is protected by password, your password is stored in encrypted form and cannot be accessed by anyone. You should keep your password private at all times. You should also remember to log out of your account and close your browser window when you have finished using the site.

    Learning Clip Ltd cannot and does not ensure or warrant the security of any information collected by use, transmitted over the Internet, or maintained in your user account. You agree that any data transmission you make or receive through the Site is at your own risk.

    Learning Clip Ltd will never make an unsolicited request for your password.

  6. Disclaimer of Liability

    Under no circumstances will Learning Clip Ltd be liable for any damages, including, but not limited to, indirect, special, incidental, consequential or exemplary damages, that result from the use of the information or materials submitted to or collected as a result of the user's accessing the Site or use of the service provided by Learning Clip Ltd, even if Learning Clip Ltd has been advised of the possibility of such damages.

  7. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive and continue to be binding and enforceable. In case of controversy or inconsistency between translations of these Terms to other languages, the English version issued by Learning Clip Ltd shall prevail.

  8. The failure or delay of Learning Clip Ltd to exercise or enforce any right in these terms does not waive Learning Clip Ltd's right to enforce that right.
